1. Terms of Service

This FileLu Service Agreement (the "Agreement") describes the terms and conditions on which FileLu ("we," "us") provides services to you ("User") through our website, including https://filelu.com and https://file.lu, including subdomains and related sites ("Website"), our mobile apps, our FileLuSync desktop app, our Linux terminal CLI script, and our application programming interface ("API").

It is essential that you read this Terms of Service in its entirety. By creating an account or using our service, you agree to be bound by its terms. By using our services, you also agree to FileLu's Privacy & Cookie Policy and the following terms:

  1. FileLu has the right to delete, move, or replace any files which come under the category of copyrighted material, harassment, or offensive material and has no responsibility for lost images, videos, or any files uploaded on FileLu.
  2. We reserve the right to disable direct linking on user accounts that are using excessive bandwidth or otherwise abusing the system.
  3. You are responsible for maintaining the confidentiality of your password, encryption key, and account security. You are fully responsible for all activities that occur under your account.
  4. FileLu has the right to ban or suspend the account of any user who does not follow FileLu rules and Terms of Service.
  5. FileLu has the right to remove any content that compromises the security of FileLu servers.
  6. FileLu has the right to terminate, suspend, block, or remove your account or files in case of any security threat, bandwidth excess, or account limitation violation.
  7. Users are strictly prohibited from creating multiple accounts on FileLu. Doing so may result in service restrictions or unintended technical issues, including possible file corruption during encryption and decryption processes.
  8. You must maintain copies of all data stored by you on our services. We do not guarantee that there will be no loss of data or that the services will be bug-free. You should download all data prior to termination of services.
  9. All emails we send are related to your account, such as registration confirmation, security confirmation, file expiration notifications, password reset confirmations, and similar account-related emails. By signing up or signing in, you agree to receive those emails. We recommend adding [email protected] to your contact list.
  10. We will store your data subject to these terms and any plan you subscribe to. If you stop using our services or stop payment, you must download your data first because your files may expire or be automatically deleted when downgrading from Premium to Regular user.
  11. Uploading content related to child abuse or animal abuse will result in an immediate ban. FileLu is strict about child abuse and will fully cooperate with legal authorities and law enforcement by providing necessary support and information.
  12. We reserve the right to disclose data and other information as required by law or competent authority. If necessary or legally required in any jurisdiction, we may provide Your Files, Account Data, or Usage Data to competent authorities, even if those items are encrypted.
  13. We respect the copyrights of others and require users to comply with copyright laws. Users must comply with all applicable laws in their location, including copyright and trademark laws. Files that violate copyrights or trademarks are not allowed.
  14. We process takedown notices based on good faith acceptance of the representations from the party submitting the takedown notice.
  15. For copyright takedown notices, please follow the DMCA Copyright Takedown Notice. If FileLu receives proper notification of claimed copyright infringement, it will respond expeditiously by removing or disabling access to the material.
  16. You may not upload, download, store, share, access, display, stream, distribute, email, link to, communicate, transmit, or otherwise make available any content that infringes any copyright or proprietary rights of any person or entity.
  17. Every time you violate our policies, you will receive 1 strike. Each strike expires after 30 days. 3 strikes within the same 30-day period will result in account suspension.
  18. While using FileLu, you agree that you may not:
    1. Upload child abuse, animal abuse, harassing, threatening, intimidating, or unlawful content.
    2. Upload content that contains, promotes, or links to shocking content, terrorism, weapons, tobacco, drugs, hacking, viruses, malware, or illegal material.
    3. Promote, depict, or link to material that promotes discrimination based on race, gender, religion, national origin, disability, sexual orientation, or age.
    4. Upload unlawful material, including content that may violate intellectual property rights.
    5. Upload content that promotes illegal activity or is otherwise deemed unsuitable.
    6. Assign or transfer rights under these terms to another person, including by sharing your password.
  19. You are responsible for keeping your password and master encryption key safe. If you lose your master key, you cannot create a new one or access your encrypted files.
  20. FileLu is a file hosting service that allows users to upload, store, and share files. FileLu is not responsible for user-uploaded content. If you see illegal or infringing content, report it to [email protected].
  21. You are solely responsible for everything you upload, share, or any interactions you have through FileLu.
  22. FileDrop liability: FileDrop allows others to upload files to your account folders. If you are the folder owner, you are solely responsible for all files stored in your account.
  23. Inactive accounts: FileLu reserves the right to remove and delete any Regular or Free account inactive for 180 days or more. Premium users maintaining Premium status do not need to worry about inactive deletion. Email reminders may be sent from [email protected].
  24. Remove files when exceeding storage limit:
    • Free Plan: If a user exceeds the free storage limit, the system may automatically delete files until storage is equal to or below the free plan capacity.
    • Premium Plan: If a user exceeds the free storage limit and later downgrades from Premium, they must restore Premium status within 30 days. Otherwise, files may be deleted to bring usage within the free plan limit.
  25. FileLu is not liable for your images, videos, documents, apps, files, or any business or personal loss due to unavailability or loss of the website. We make no claims of future reliability in serving, hosting, or storing your files.
  26. FileLu is not responsible for file loss or account limitations due to payment declines or issues preventing automatic payment renewal. Keep your payment method valid and up to date.

2. Data Deletion Policy

We respect your right to privacy and understand that you may wish to delete your data from our servers at any time. Upon receiving a data deletion request, we will promptly remove personal data associated with your account, including files, metadata, and other information that can identify you.

We may need to retain some data for legal compliance, such as transactional data or billing information, as required by law. We may also retain data to protect our interests in legal disputes. Such data will only be retained as long as necessary and securely deleted when no longer required.


3. Referral Program

Our platform offers a referral program that allows users to earn additional storage space by referring friends and new users. Referred users must create an account with a valid username, password, and verified email address.

Only referrals who complete registration with verified email, username, and password are valid. Creating multiple accounts solely to increase referral rewards is prohibited and may result in cancellation of referral rewards and account consequences.


4. Trademarks

The FileLu.com logo, the word "FileLu" or "FILELU", and slogans on the Site or available through the Service are trademarks of FileLu, LLC and its suppliers or licensors. They may not be copied, imitated, or used without prior written permission.

You may not use metatags or hidden text using FileLu.com or any FileLu trademark, product, or service name without permission. All other trademarks, product names, and company names are the property of their respective owners.


5. Cancel Anytime

You may cancel your FileLu Premium subscription before your next billing period.

Cancel Recurring Payment

"Cancel anytime" means you can turn off auto-renewal whenever you want. If you cancel at least 48 hours before your renewal date, you will not be charged for subsequent billing periods. If you do not cancel at least 48 hours before renewal, your subscription may renew automatically and refunds will not be provided for renewal charges if you fail to cancel before renewal.


6. Recurring Paid Subscriptions

Recurring subscriptions renew indefinitely, either monthly or annually, unless canceled before the renewal date. For subscriptions via mobile apps using in-app purchases, refer to your app store account for dates and terms.

Other recurring subscriptions renew on the same day of the month as established, except when that day is unavailable due to a shorter month. Visit My Subscriptions.

We reserve the right to change Premium plan prices at any time. New orders reflect updated prices. Existing subscriptions may continue renewing at the old price until canceled or updated.

For Free and Unregistered plans, we reserve the right to make changes at any time without prior notice, including changes to features, functionality, and limitations.


7. One-Time Payment Plan (Lifetime Plan)

Our One-Time Payment Plan is valid for 99 years from the date of purchase, as long as our business continues to operate. We define Lifetime as 99 years or the lifetime of the account holder, whichever is shorter.

This plan is non-transferable and cannot be resold. It is for the exclusive use of the individual who purchased it and cannot be passed to the next generation or another party. After 99 years, the plan expires and access to its benefits ends.


8. Refund Policy
  • FileLu may approve a 15-day money-back guarantee. Refund requests should be submitted by email to [email protected] or by creating a support ticket.
  • This guarantee applies only to first-time purchases. Subsequent purchases, renewals, or upgrades are not eligible.
  • FileLu may deny refund requests where abuse is detected, such as repeated refund requests from the same user or related accounts.
  • Refunds may require a valid reason. Requests without sufficient reason may not be approved.
  • You may cancel Premium at any time. Refunds are only issued if required by law. Before deleting your account, cancel any Premium subscription or recurring payment to avoid continued charges.

9. Disputed Payments and Chargebacks

If you dispute a valid charge, including a subscription renewal, with your bank or payment provider instead of contacting us for support or cancellation, we reserve the right to terminate or permanently suspend your account and associated services. Contact support before initiating a dispute.


10. Disclaimer

FileLu monitors uploaded files and applies rules to regulate file-sharing behavior, but FileLu is not responsible for user-uploaded content or affiliated with entities represented in uploaded files. We take abuse and copyright reports seriously.

Services and the website are provided "as is." All implied warranties are excluded as much as permitted by law, including warranties of merchantability, fitness for purpose, safety, reliability, durability, title, and non-infringement.

FileLu is not liable for file loss, personal loss, business loss, loss of profits, loss of revenue, or loss of use due to service unavailability or website loss.

Disclaimer of Liability: The Service is provided on an "as is" and "as available" basis. FileLu makes no representations or warranties of any kind and will not be liable for damages arising from use of the Service.

Limitation of Liability: FileLu shall not be liable for lost profits, business interruption, indirect, special, incidental, or consequential damages arising from use or inability to use the Service.

10.a Accessibility & Disability Compliance

We strive to make our Website and Services accessible to all users, including those with disabilities. However, we cannot guarantee that all features or content fully comply with every interpretation of applicable accessibility laws, such as the ADA.

If you experience difficulty using the Website or any feature, you agree to notify us in writing so we may attempt to remedy the issue. You agree not to commence any formal accessibility claim unless you first provide 30 days’ written notice and an opportunity to cure.

To the fullest extent permitted by law, our liability for accessibility-related claims is limited in the same manner as other claims under this Agreement.

10.b Scope of Services and Intended Users

FileLu provides cloud storage and data-transfer tools designed for technically experienced users, developers, and organizations. Services include website uploads, folder uploads, URL remote uploads, FTP/FTPS, WebDAV, S3-compatible storage, Rclone integration, FileLuSync apps, mobile apps, browser extensions, API endpoints, CLI utilities, and encryption tools.

Certain features may require intermediate to advanced technical knowledge or third-party software. By using FileLu, you acknowledge that:

  • You have or will obtain the necessary technical understanding or assistance to configure and operate these tools safely and effectively.
  • FileLu is not responsible for errors, data loss, or misconfigurations resulting from improper setup or use of advanced tools.
  • FileLu services are offered as is and may require maintenance or updates for compatibility with third-party software.

11. Miscellaneous Legal

This Agreement and any rights and licenses granted hereunder may not be transferred or assigned by you, but may be assigned by FileLu without restriction.


12. Penetration Testing

Prior to conducting penetration testing on FileLu systems, users must obtain explicit permission from FileLu. Requests should be sent to [email protected]. Unauthorized penetration testing may result in legal action.

Indemnification: You agree to indemnify and hold FileLu and its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to your use of the Service, violation of these Terms, or violation of another party’s rights.

Changes to Terms: We reserve the right to modify these Terms as internet use and abuse evolve. If we do, we will post notice on our home page. Continued use of the Service after changes constitutes acceptance of the new Terms.

This Agreement shall be construed under the laws of the State of Florida, without reference to choice of law principles. You and FileLu consent to personal jurisdiction of federal or state courts located in Orange County, Florida.

These Terms, together with the Privacy Policy and other legal notices published by FileLu, constitute the entire agreement between the parties. If any provision is held invalid, illegal, or unenforceable, the remaining provisions remain effective.

No failure or delay in exercising or enforcing this policy shall constitute a waiver. If any provision is deemed unenforceable due to law or change in law, that provision shall be disregarded and the balance of the Agreement remains in effect.

Limitation of Claims: YOU AND FILELU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ARISES; OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

All disagreements will be heard in Orange County, Florida, USA within one year.

You are over 18 and have authority to accept this Agreement, or you are between 16 and 18 and your parents have accepted this Agreement on your behalf. If you are under 16 years old, do not use the Service.
